TERMS OF USE

These Terms and Conditions govern your use of the Wiseradviser website, www.wiseradviser.org (the Charity Site) and your relationship with Money Advice Trust (the Charity, we or us). Please read them carefully as they affect your rights and liabilities under the law. If you do not agree to these Terms and Conditions, please do not register for or use the Charity Site. 1 Use of the Charity Site

1.1 The Charity Site is provided to you for your use subject to these Terms and Conditions. By using the Charity Site you agree to be bound by these Terms and Conditions. References to these Terms and Conditions include the Privacy Policy, Cookies Policy and the Booking Terms and Conditions (within the learning section of the Charity Site).

2 Amendments

2.1 We may update these Terms and Conditions from time to time for legal or regulatory reasons or to allow the proper operation of the Charity Site. Any changes will be notified to you via the e-mail address provided by you on registration or via a suitable announcement on the Charity Site. The changes will apply to the use of the Charity Site after we have given notice. If you do not wish to accept the new Terms and Conditions you should not continue to use the Charity Site. If you continue to use the Charity Site after the date on which the change comes into effect, your use of the Charity Site indicates your agreement to be bound by the new Terms and Conditions.

3 Registration

3.1 In order to access most sections of the Charity Site you need to register.

3.2 The registration protected areas of the Charity Site are for the use of advisers meeting our eligibility criteria.

3.3 It is a condition of registration that you provide your name, contact details, organisation details and supervisor details. If you do not access the Charity Site for nine months or more, the Charity will deactivate your account.

3.4 We reserve the right to terminate your registration if we learn that you have provided false or misleading registration information.

3.5 To register on the Charity Site you must be over eighteen years of age.

3.6 You must ensure that the details provided by you on registration or at any time are correct and complete.

3.7 You must inform us immediately of any changes to the information that you provided when registering by updating your personal details in order that we can communicate with you effectively.

3.8 In order for the site to work more effectively and to provide you with the best possible user experience, we use Cookies on this website. You must ensure that your browser settings are set to enable Cookies on this site. Should you have any questions regarding the Cookies that are set, then please view our Cookies Policy.

4 Password and security

4.1 In order to prevent fraud, you must keep your username and password confidential and must not disclose them or share them with anyone. If you know or suspect that someone else knows your username and password you should notify us by contacting contactus@moneyadvicetrust.org immediately. You are the only person who can use your username and password.

4.2 You agree to immediately notify the Charity if you believe your password is no longer private or if you suspect any unauthorised use of your registration or password. If the Charity has reason to believe that there is likely to be a breach of security or misuse of the Charity Site, we may require you to change your password or we may suspend your account.

4.3 Should you cease to be eligible to use the registration-protected areas of the Charity Site you must inform the Charity by emailing us at contactus@moneyadvicetrust.org. Your registration will then be terminated.

5 Intellectual property

5.1 The content of the Charity Site is protected by copyright, trade marks, database right and other intellectual property rights. You may retrieve and display the content of the Charity Site on a computer screen, store such content in electronic form on disk (but not any server or other storage device connected to a network) or print one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices. You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on the Charity Site without written permission from the Charity.

6 Your use of the Charity Site

6.1 You may not use the Charity Site for any of the following purposes:

6.1.1 disseminating any unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material or otherwise breaching any laws;

6.1.2 transmitting material that encourages conduct that constitutes a criminal offence or otherwise breaches any applicable laws, regulations or code of practice;

6.1.3 interfering with any other person 's use or enjoyment of the Charity Site. You will not behave in an abusive manner and will not harass, threaten, or attack anyone. If you disagree with someone's message, you will not attack that person, but agree to disagree, respectfully;

6.1.4 making, transmitting or storing electronic copies of materials protected by copyright without the permission of the owner;

6.1.5 posting any material that is false, misleading, inaccurate, or cannot be substantiated;

6.1.6 posting messages that are clearly outside of the stated topic of that discussion, or disrupt a discussion by, for example, deliberately posting repeated or irrelevant messages or copies of identical messages;

6.1.7 adversely affecting the availability of its resources to other users (e.g. continually posting repetitive text);

6.2 You will, if asked by a representative of the Charity, cease or amend any posting deemed to breach these Terms and Conditions by the moderators.

6.3 You will be responsible for our losses and costs resulting from your breach of this clause 6.

7 Moderator intervention

7.1 We reserve the right, at our sole discretion, to immediately, without notice edit or remove your message or topic. We will make reasonable efforts to inform you of this action and to indicate our intervention in the Charity Site discussions to all users.

8 User Intervention

8.1 If you find any posts in the forum to be offensive or objectionable, please advise us by email contactus@moneyadvicetrust.org.

8.2 If we determine that removal of a post or posts is necessary, we will make reasonable efforts to do so in a timely manner.

9 Content Disclaimer

9.1 The views expressed in the posts on the Charity Site discussion belong solely to their respective authors and do not necessarily reflect the views of the Charity or our partner agencies (or their respective network organisations)

9.2 Please remember that, as all registered users can post messages directly on to the Charity Site discussions, it is impossible for the Charity to guarantee the validity of the content of any user posts. The Charity is not responsible for any user posts or for the consequences of following any advice offered within these posts. It is solely your responsibility to evaluate the accuracy, completeness and usefulness of all opinions, advice and other information provided through the Charity Site discussions.

10 Availability of the Charity Site

10.1 Although we aim to offer you the best service possible, we make no promise that the services at the Charity Site will meet your requirements. We cannot guarantee that the services will be fault-free. If a fault occurs with the Charity Site you should report it to contactus@moneyadvicetrust.org and we will attempt to correct the fault as soon as we reasonably can.
10.2 Your access to the Charity Site may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. We will attempt to restore the service as soon as we reasonably can.

11 The Charity &aposs right to suspend or cancel your registration

11.1 We may suspend or cancel your registration or ability to access the Charity Site discussions immediately at our reasonable discretion or if you breach any of your obligations under these Terms and Conditions.

11.2 You can cancel your registration at any time by informing us in writing at contactus@moneyadvicetrust.org. If you do so, you must stop using the Charity Site.

11.3 The suspension or cancellation of your registration and your right to use the Charity Site shall not affect either party's statutory rights or liabilities.

12 The Charity\u2019s liability

12.1 The Charity Site provides content from other internet sites or resources and while the Charity tries to ensure that material included on the Charity Site is correct, reputable and of high quality, it does not make any warranties or guarantees in relation to that content. If the Charity is informed of any inaccuracies in the material on the Charity Site we will attempt to correct the inaccuracies as soon as we reasonably can.
12.2 If we are in breach of these Terms and Conditions, we will only be responsible for any losses that you suffer as a result to the extent that they are a foreseeable consequence to both of us at the time you use the Charity Site. Our liability shall not, in any event, include business losses such as lost data, lost profits or business interruption.

12.3 This clause 12 shall not limit or affect our liability resulting from any products sold through the Charity Site being found to be unsafe or if something we do negligently causes death or personal injury.

13 Third Party Websites

13.1 The Charity Site includes links to other web sites or material which are beyond the Charity's control. The Charity is not responsible for content on any site outside the Charity Site.

14 Advertising and Sponsorship

14.1 Part of the Charity Site may contain advertising and sponsorship. Advertisers and sponsors are responsible for ensuring that material submitted for inclusion on the Charity Site complies with relevant laws and codes. We will not be responsible to you for any error or inaccuracy in advertising and sponsorship material.

15 Applicable Law

15.1 These Terms and Conditions will be subject to the laws of England and Wales. We will try to resolve any disagreements quickly and efficiently. If you are not happy with the way we deal with any disagreement and you want to take court proceedings, you must do so within England and Wales.

16 International Use

16.1 We make no promise that materials on the Charity Site are appropriate or available for use in locations outside the United Kingdom, and accessing the Charity Site from territories where its contents are illegal or unlawful is prohibited. If you choose to access the Charity Site from locations outside the United Kingdom, you do so on your own initiative and are responsible for compliance with local laws.

17 Miscellaneous

17.1 You may not transfer any of your rights under these Terms and Conditions to any other person. We may transfer our rights under these Terms and Conditions to another business where we reasonably believe your rights will not be affected.

17.2 If you breach these Terms and Conditions and the Charity chooses to ignore this, the Charity will still be entitled to use its rights and remedies at a later date or in any other situation where you breach the Terms and Conditions.

17.3 The Charity shall not be responsible for any breach of these Terms and Conditions caused by circumstances beyond its reasonable control.

17.4 The Charity Site is owned and operated by Money Advice Trust, 21 Garlick Hill, London EC4V 2AU.
